BlueCat Marketing, doing business as BlueCat (“BlueCat,” “Company,” “us,” or “we”), a Florida-based business, respects and protects the privacy of visitors to our website, www.bluecatweb.com, and any other websites or pages operated by or on behalf of BlueCat that link to this Privacy Policy (collectively, the “Sites”).
This Global Privacy Policy (“Policy”) explains how we collect, use, disclose, and safeguard information from visitors to the Sites. Any reference in this Policy to your use of the Sites includes your visits and interactions with the Sites, regardless of whether you later engage with BlueCat through a separate offer, agreement, or arrangement. BlueCat does not operate a software platform or deliver services through the Sites, and this Policy applies solely to information collected via the Sites.
Capitalized terms not otherwise defined in this Policy have the meanings assigned to them in any applicable terms, agreements, or policies referenced on the Sites, as amended from time to time.
By accessing or using the Sites, you acknowledge that you have read, understood, and agree to this Privacy Policy. If you do not agree with any portion of this Policy or are not comfortable with our practices, you should discontinue access to and use of the Sites.
1. What “Personal Information” means
In this Policy, “Personal Information” means any information that relates to, describes, identifies, or could reasonably be linked to an identifiable natural person. Except as expressly described in this Policy, BlueCat does not sell, rent, lease, or otherwise disclose Personal Information to third parties for their independent use.
Personal Information does not include information that has been aggregated, anonymized, or de-identified so that it cannot reasonably be used to identify an individual (“De-identified Data”). De-identified Data allows us to understand how the Sites are used, evaluate performance, and make informed decisions about improvements, content, and functionality. We may use De-identified Data internally and may share such De-identified Data with third parties, including service providers and partners, for analytical, operational, business, and research purposes, including to improve the Sites and related offerings.
2. How we collect, use, and share your Personal Information and other information
a. Information you provide to us
When you interact with the Sites, you may voluntarily provide Personal Information to us. This may occur when you submit a contact form, an enrollment or interest form, request information, or otherwise communicate with us through the Sites. The Personal Information you provide may include your name, email address, phone number, and any additional information you choose to include in your message or inquiry. Because the Sites are informational and marketing-focused, we do not require account registration, do not create user profiles, and do not provide user dashboards or software tools through the Sites. Accordingly, we do not collect information related to account credentials, ongoing usage activity, or content creation within a platform environment. Any information you submit is provided at your discretion and solely for the purpose of enabling us to respond to your inquiry or communicate with you. We may retain the contents of communications you send to us, including emails and form submissions, and may use such information to respond to requests, maintain internal records, improve our communications, and comply with applicable legal obligations.
BlueCat may use Personal Information you provide to communicate with you, respond to inquiries, provide information about our offerings, evaluate interest in potential services or arrangements, conduct internal research and analysis, and improve the content, structure, and functionality of the Sites. Where permitted by law, we may also use such information to send marketing or informational communications, which you may opt out of at any time.
We do not request sensitive personal data through the Sites, and we will never ask you to provide passwords, account credentials, or payment information via email or unsolicited communications. If you receive a communication purporting to be from BlueCat requesting such information, you should contact us directly using the information provided in this Policy.
If, in the future, payment information is collected in connection with offers or agreements referenced on the Sites, such information would be processed solely as authorized by you and typically handled by third-party payment processors. BlueCat does not currently store credit card information and, if applicable in the future, will use commercially reasonable efforts to protect any financial or Personal Information processed in connection with such transactions.
b. Information we may receive from and share with third parties
We may receive Personal Information about you from third parties that support the operation of the Sites or our communications, such as website hosting providers, analytics providers, email delivery services, or security and spam-prevention services. This information may include technical or usage data, delivery confirmation data, or information necessary to ensure the proper functioning and security of the Sites.
We may share Personal Information with third-party service providers to the extent necessary for them to perform services on our behalf. These service providers are authorized to use Personal Information only as necessary to provide their services to us and are not permitted to use such information for their own independent purposes. Where required, we enter into appropriate contractual arrangements with service providers to protect Personal Information.
We do not permit third parties to use Personal Information for their own marketing purposes without your consent.
c. Application integrations and external tools
The Sites do not provide application integrations, user-connected tools, or third-party software connections that require you to link external accounts or provide access credentials. Accordingly, we do not store application credentials or access third-party accounts on your behalf through the Sites.
If, in the future, limited integrations or tools are made available in connection with invitation-only offers or agreements, any information exchanged in that context would be governed by this Policy and any additional terms presented at the time of access.
d. Log file and technical information
We automatically collect certain technical information when visitors access the Sites. This information may include Internet Protocol (IP) addresses; date and time of access; browser type and version; operating system; referring URLs; language preferences; time zone; device identifiers; and other similar log or diagnostic data.
We use this technical information to monitor Site traffic, maintain security, detect and prevent misuse, analyze performance trends, and improve the overall operation and reliability of the Sites. This information is not used to identify individuals beyond what is necessary for these purposes.
e. Other information disclosure and use
We may disclose Personal Information when required to respond to subpoenas, court orders, law enforcement requests, or governmental investigations, or when necessary to establish, exercise, or defend our legal rights. We may also disclose information if we believe such action is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, security incidents, or situations involving potential threats to the safety of any person, or as otherwise required by law.
We use information collected through cookies, log files, and similar technologies to:
- Remember information so you do not have to re-enter it during future visits
- Understand how visitors interact with the Sites
- Monitor and improve Site performance and effectiveness
- Analyze aggregate traffic and usage patterns
- Diagnose and address technical issues
- Maintain the security and integrity of the Sites
Personal Information may be accessible to authorized BlueCat personnel and contractors who require access for legitimate business purposes, provided that such access is consistent with this Policy and applicable law.
3. Links to other websites
The Sites may contain links to websites, services, or applications that are not owned or controlled by BlueCat, including those operated by third parties. This Privacy Policy applies only to information collected through the Sites and does not apply to information collected by any third-party websites or services.
BlueCat does not endorse, control, or assume responsibility for the content, privacy practices, or policies of any third-party websites or services. Any interactions you have with third-party websites, including those accessed through links on the Sites, are governed by the terms and privacy policies of those third parties, not this Policy. We do not control and are not responsible for any third parties that you choose to interact with or authorize to access information outside of the Sites. If you access or use a third-party website or service through a link on the Sites, you do so at your own discretion and risk.
4. Public forums
The Sites do not currently offer publicly accessible blogs, message boards, comment sections, or community forums that allow visitors to post content visible to other users. As a result, BlueCat does not knowingly make Personal Information publicly available through interactive public features on the Sites.
If public-facing features are introduced in the future, any information or content you voluntarily choose to post in such areas may be viewable by others and may become publicly available, subject to any applicable privacy controls. Please be aware that information disclosed in public areas may be collected, used, and retained by others, and copies of such information may remain accessible even after removal.
If you believe that Personal Information has been made publicly available through the Sites and wish to request its removal, you may contact us using the information provided in the Contact Us section below. We will review and respond to such requests in accordance with applicable law, though we may not be able to remove information that has been cached, archived, or reposted by third parties.
5. Customer testimonials / comments / reviews
From time to time, BlueCat may display testimonials, comments, or reviews on the Sites that relate to our work, offerings, or experiences shared by individuals or businesses. Such testimonials may include Personal Information, such as a name, business name, or other identifying details.
We obtain consent prior to publishing any testimonial or review that includes Personal Information. If you wish to update or request removal of a testimonial that includes your Personal Information, you may contact us using the information provided in the Contact Us section below.
6. Protection of information
BlueCat is committed to protecting the security and confidentiality of Personal Information collected through the Sites. We use commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, disclosure, alteration, or destruction. These measures may include access controls, secure hosting environments, and other generally accepted security practices appropriate to the nature of the information collected.
Information submitted through the Sites is transmitted using industry-standard security technologies, such as secure socket layer (SSL) encryption, where applicable. These measures are intended to help ensure that Personal Information is handled in a secure manner and accessed only by authorized personnel or service providers acting on our behalf.
Despite these efforts, no method of transmission over the Internet or method of electronic storage is completely secure or error-free. Accordingly, BlueCat cannot guarantee absolute security of information transmitted to or stored through the Sites, and you should exercise discretion when deciding what information to submit. BlueCat is not responsible for the security practices or measures implemented by third parties whose websites or services may be linked to or used in connection with the Sites.
7. Hosting and data transfer
BlueCat is based in the United States, and information collected through the Sites may be hosted, stored, transferred, and processed in the United States or in other countries where our service providers or infrastructure are located. These jurisdictions may have data protection laws that differ from those in your place of residence.
We use a combination of contractual, technical, and organizational safeguards intended to protect Personal Information when it is transferred or processed. BlueCat takes reasonable steps to ensure that third-party service providers that process Personal Information on our behalf are subject to appropriate confidentiality and data protection obligations consistent with this Policy and applicable law.
The Sites are intended primarily for a U.S.-based audience. BlueCat does not currently make representations regarding compliance with specific international data transfer frameworks, such as the EU-U.S. Data Privacy Framework or similar regimes. If you access the Sites from outside the United States, you acknowledge and agree that your information may be transferred to and processed in the United States or other jurisdictions, and that such transfers may not provide the same level of data protection as the laws of your home country.
By using the Sites and providing information to BlueCat, you consent to the transfer, storage, and processing of your information as described in this Policy.
8. Choice
You may choose whether or not to provide Personal Information through the Sites. Declining to submit Personal Information may limit our ability to respond to inquiries, provide requested information, or communicate with you, but it will not prevent you from browsing the Sites.
If you receive marketing or informational communications from BlueCat and wish to opt out, you may do so by following the unsubscribe instructions included in those communications or by contacting us directly using the information provided in the Contact Us section below. Opting out of marketing communications will not affect non-promotional communications, such as responses to inquiries you initiate.
You may also control or disable cookies and similar tracking technologies through your browser or device settings. Please refer to your browser or mobile device documentation for instructions on managing cookie preferences and other tracking controls. Disabling cookies may limit certain features or functionality of the Sites and may affect how analytics information is collected.
At this time, BlueCat does not sell Personal Information or engage in interest-based advertising that requires participation in industry opt-out programs. If advertising or tracking practices change in the future, additional opt-out mechanisms consistent with applicable law may be provided.
9. Correcting and updating your information
Because the Sites do not provide user accounts or require registration, there is no self-service mechanism to directly access, update, or delete Personal Information through a user dashboard. If you have submitted Personal Information to BlueCat through the Sites and would like to request access to, correction of, or deletion of that information, you may contact us using the information provided in the Contact Us section below.
We will respond to such requests in accordance with applicable law and may take reasonable steps to verify your identity before processing a request. Please note that certain information may be retained as required or permitted by law, including for recordkeeping, legal, security, or compliance purposes.
BlueCat does not maintain Personal Information on behalf of third parties or end users through the Sites. Any requests relating to information collected by third-party websites or services should be directed to the applicable third party.
10. Data retention
BlueCat retains Personal Information collected through the Sites only for as long as reasonably necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by applicable law. Retention periods may vary depending on the nature of the information, the context in which it was collected, and applicable legal or regulatory requirements.
We may retain and continue to process Personal Information as necessary to comply with legal obligations, maintain accurate business and operational records, resolve disputes, enforce our agreements, and protect the security and integrity of the Sites. When Personal Information is no longer required for these purposes, we take reasonable steps to delete or anonymize it in accordance with our internal retention practices.
11. Offers and invitation-only pages
Certain pages, offers, and viewable agreements made available through the Sites may be accessible only by invitation, including access provided through direct communication, text message, or verbal discussion. These pages may contain informational materials, proposed terms, or view-only agreements intended solely for the invited recipient.
Access to invitation-only pages does not, by itself, create a client relationship, service relationship, or contractual obligation unless expressly stated in a separate written agreement. Any Personal Information submitted in connection with such pages is collected and used in accordance with this Privacy Policy and any additional terms presented at the time of access.
12. Advertising and marketing practices (if applicable)
BlueCat does not currently sell Personal Information or engage in cross-context behavioral advertising based on Personal Information collected through the Sites. Information collected through the Sites may be used to communicate with you about BlueCat, respond to inquiries, or provide information about offerings that may be relevant to you, subject to applicable law and your communication preferences. If advertising, remarketing, or additional marketing technologies are introduced in the future, such practices will be conducted in accordance with this Privacy Policy and applicable law, and appropriate disclosures and choices will be provided where required.
13. Children’s Personal Information
The Sites are not directed to children under the applicable age of consent, and BlueCat does not knowingly collect Personal Information from children under the age of 13. If you are under 13 years of age, you should not submit any Personal Information through the Sites.
We encourage parents and legal guardians to monitor their children’s internet usage and to instruct children not to provide Personal Information through the Sites. If you believe that a child under the age of 13 has submitted Personal Information to BlueCat through the Sites, please contact us, and we will take reasonable steps to delete such information promptly.
14. Your California privacy rights
This section applies solely to residents of the State of California. Under the California Consumer Privacy Act of 2018, as amended (“CCPA”), California residents have specific rights regarding their Personal Information. This section summarizes the categories of Personal Information BlueCat may collect through the Sites, the purposes for which such information is collected, the sources of the information, and the categories of third parties with whom such information may be shared.
When you interact with the Sites, we may collect the following categories of Personal Information, as defined by the CCPA: identifiers such as name, email address, phone number, and Internet Protocol (IP) address; internet or other electronic network activity information, including browsing history, pages viewed, referring URLs, length of visit, and interaction data; and professional or business-related information to the extent you voluntarily provide such information in connection with an inquiry. We generally do not collect sensitive personal information, biometric information, precise geolocation data, or education-related information through the Sites.
We collect and use Personal Information for the business and commercial purposes described in Section 2 of this Policy, including operating and improving the Sites, responding to inquiries, analyzing usage, maintaining security, and complying with legal obligations. The CCPA defines a “business purpose” as the use of Personal Information for operational purposes that are reasonably necessary and proportionate to achieve the purpose for which the information was collected, and our use of Personal Information is limited to those purposes.
The categories of third parties with whom we may share Personal Information include service providers that assist with hosting, analytics, email delivery, and security, as further described in Section 2 of this Policy. BlueCat does not sell Personal Information as defined under the CCPA.
15. U.S. State Privacy Rights
Residents of certain U.S. states may have additional rights regarding their Personal Information under applicable state privacy laws, including, for example, California, Colorado, Connecticut, Virginia, Utah, and other states that enact similar requirements. These rights may be subject to limitations, exceptions, and verification requirements. In some circumstances, we may be unable to fulfill a request if doing so would create a substantial, articulable, and unreasonable risk to the security of Personal Information, the Sites, or our systems, or where disclosure is otherwise restricted by law. Depending on your state of residence, your rights may include:
Right Against Discrimination.
You may have the right not to receive discriminatory treatment for exercising privacy rights. BlueCat will not discriminate against you for exercising rights available under applicable law, including requests to know or delete Personal Information, or to opt out of certain processing where such opt-out rights apply.
Right to Know / Access.
You may have the right to request information about our collection and use of your Personal Information. This may include requesting: (i) the categories of Personal Information we have collected about you; (ii) the categories of sources from which the Personal Information is collected; (iii) the business or commercial purposes for collecting or using the Personal Information; (iv) the categories of third parties with whom we have shared Personal Information; and (v) in some cases, the specific pieces of Personal Information we maintain about you. Where required by law, you may also request information about certain disclosures of Personal Information for third parties’ direct marketing purposes.
Right to Delete.
You may have the right to request that we delete Personal Information we have collected from you or maintain about you, subject to exceptions permitted by law, including where retention is necessary for security, legal compliance, recordkeeping, or to complete or respond to a transaction or request you initiated.
To exercise an applicable right to know/access or delete, please contact us using the details provided in the Contact Us section below. To protect your information, we may take reasonable steps to verify your identity before processing a request, including asking you to confirm information we already have on file. If we cannot verify your identity using information on file, we may request additional information, which will be used solely for verification and security or fraud-prevention purposes.
Right to Opt Out of Sale or Certain Sharing (Where Applicable).
BlueCat does not sell Personal Information as that term is defined under the CCPA. In addition, we do not currently engage in practices that constitute “sharing” of Personal Information for cross-context behavioral advertising under the CCPA. If our practices change, we will provide notice and any required opt-out mechanisms consistent with applicable law.
California residents may also have additional rights under California Civil Code sections 1798.83–1798.84 (sometimes referred to as “Shine the Light”), which may permit requests regarding certain disclosures of Personal Information to third parties for their direct marketing purposes. If you are a California resident and would like to make such a request, you may submit it using the contact information in the Contact Us section below.
16. Changes to the Privacy Policy
BlueCat reserves the right to modify, update, or revise this Privacy Policy from time to time in the ordinary course of business, and we encourage you to review this Policy periodically to remain informed of our information practices. When we make changes that are material, we will update the effective date at the top of this page and, where appropriate, provide reasonable notice before such changes take effect.
Notice of updates may be provided through the Sites, via email communications, or through other reasonable means, at our discretion. We reserve the right to determine the form and method of providing notice, consistent with applicable law. In certain circumstances, you may be required to affirmatively acknowledge or accept an updated version of this Policy.
The updated Policy will be effective as of the date indicated at the top of the page and will apply to information collected from that point forward. Your continued access to or use of the Sites after the effective date of an updated Policy constitutes your acceptance of the revised terms. If you do not agree to this Policy or any future updates, you must discontinue use of the Sites. BlueCat is not responsible for any filtering or blocking of notification emails by you or your network or email service provider.
17. Business transactions
BlueCat may assign or transfer this Privacy Policy and any Personal Information collected through the Sites to a successor or other entity in connection with a merger, acquisition, reorganization, sale of assets, financing, bankruptcy, dissolution, or similar corporate transaction. Such transfers may occur as part of due diligence or the completion of a transaction.
Any entity that acquires or receives Personal Information in this context will be required to honor this Privacy Policy or provide notice of any material changes to applicable privacy practices, consistent with applicable law.
